Terms of Service

1. Acceptance of Terms

By accessing and using TranscriptKit (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, please do not use our service. These Terms of Service ("Terms") govern your access to and use of TranscriptKit, including our website, applications, and services.

2. Description of Service

TranscriptKit provides video transcription services for publicly available videos from platforms including TikTok, YouTube, Instagram, and other supported platforms. We use third-party APIs and AI technology to generate transcripts. Our service is a digital software-as-a-service (SaaS) product that processes video content to create text transcripts.

TranscriptKit operates as a digital service provider. We do not host, store, or distribute video content. We only process video URLs provided by users to generate transcripts. All transcriptions are processed through secure third-party APIs and AI technology.

3. User Responsibilities and Acceptable Use

You agree to:

  • Only transcribe videos that you have the right to access and transcribe
  • Not use the service for any illegal or unauthorized purpose
  • Not attempt to circumvent usage limits or restrictions
  • Comply with all applicable laws and regulations
  • Provide accurate information when creating your account
  • Maintain the security of your account credentials
  • Not use the service to transcribe content that violates intellectual property rights
  • Not use the service for any prohibited activities as outlined in Section 8

4. Usage Limits and Subscription Plans

Free users are limited to a 1-time free trial (Gmail sign-in required). Paid subscribers have monthly limits based on their plan. Exceeding these limits may result in service suspension or require upgrading to a higher tier plan. Usage limits are clearly displayed on our pricing page and in your account dashboard.

Subscription plans are billed monthly in advance. You will be charged at the beginning of each billing cycle. If you upgrade your plan, you will be charged the prorated difference immediately. If you downgrade your plan, the change will take effect at the start of your next billing cycle.

5. Payment Terms

All payments are processed securely through our payment processor, Creem, who serves as our Merchant of Record. By making a purchase, you agree to the payment terms set forth by our payment processor.

Subscription fees are billed monthly in advance. All prices are displayed in USD unless otherwise stated. You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

We reserve the right to change our pricing at any time. Price changes will be communicated to existing subscribers at least 30 days in advance. Continued use of the service after a price change constitutes acceptance of the new pricing.

6. Refunds & Cancellation

6.1 Subscription Cancellation

You may cancel your subscription at any time through your account dashboard or by contacting our support team. When you cancel your subscription, you will continue to have access to the service until the end of your current billing period. No refunds will be provided for the current billing period, but you will not be charged for subsequent billing periods.

To cancel your subscription, you can either:

  • Use the cancellation feature in your account dashboard
  • Access the Creem Customer Portal to manage your subscription
  • Contact our support team at support@transcriptkit.com

6.2 Refund Policy

We are committed to providing excellent customer service and resolving any issues promptly. Refund requests are handled on a case-by-case basis and are subject to the following terms:

  • Refund Requests: If you are dissatisfied with our service, please contact our support team within 14 days of your purchase. We will review your request and respond within 3 business days.
  • Timely Response Requirement: We are committed to responding to all customer requests within 3 business days. If we fail to respond to your refund request within this timeframe, our payment processor (Creem) reserves the right to issue a refund on our behalf to ensure customer satisfaction.
  • Eligible Refunds: Refunds may be provided for:
    • Service outages or technical issues that prevent you from using the service
    • Billing errors or unauthorized charges
    • Failure to deliver the service as described
  • Non-Refundable: Refunds will not be provided for:
    • Usage of the service during the billing period
    • Change of mind after using the service
    • Violation of these Terms resulting in account suspension
  • Processing Time: Approved refunds will be processed within 5-10 business days and will be credited to the original payment method used for the purchase.

7. Intellectual Property

TranscriptKit does not claim ownership of the videos you transcribe or the resulting transcripts. You retain all rights to your content. However, you grant us a limited license to process your requests and generate transcripts.

The TranscriptKit service, including our website, software, logos, and trademarks, are the property of TranscriptKit and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our service without our express written permission.

You represent and warrant that you have the right to transcribe any video content you submit to our service. You are solely responsible for ensuring that your use of our service complies with all applicable copyright and intellectual property laws.

8. Prohibited Uses

You agree not to use the Service for any of the following prohibited purposes:

  • Transcribing content that violates intellectual property rights
  • Transcribing illegal, harmful, or offensive content
  • Using the service to violate any applicable laws or regulations
  • You may not use TranscriptKit to process or distribute pornographic, sexually explicit, or otherwise illegal content, or to promote any products and services prohibited by our payment processor.
  • Attempting to reverse engineer, decompile, or extract the source code of our service
  • Using automated systems or bots to access the service without authorization
  • Interfering with or disrupting the service or servers
  • Impersonating any person or entity or misrepresenting your affiliation
  • Collecting or harvesting information about other users

Violation of these prohibited uses may result in immediate termination of your account and legal action where appropriate.

9. Service Availability and Modifications

We strive to provide reliable service, but we do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice. We will make reasonable efforts to notify users of significant changes that may affect their use of the service.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee:

  • 100% accuracy of transcriptions
  • Uninterrupted or error-free service availability
  • That the service will meet your specific requirements
  • That any errors will be corrected

We use third-party AI technology and APIs, and the accuracy of transcriptions depends on various factors including video quality, audio clarity, and language complexity.

11. Limitation of Liability

To the maximum extent permitted by law, TranscriptKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect our service and other users.

Upon termination, your right to use the service will immediately cease. We may delete your account data in accordance with our Privacy Policy. You may terminate your account at any time by canceling your subscription and contacting our support team.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the service after changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the service and cancel your subscription.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from or related to these Terms or the service shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be subject to the exclusive jurisdiction of the courts as determined by applicable law.
